Andalucian President invited to take a holiday in Cármenes del Mar

The residents of Carmenes del Mar have invited the Andalusian president, Juanma Moreno, to spend a few days of his summer holidays in the urbanisation to remind him of his promise to carry out emergency works to reduce the risk of further harm to the homes and residents of Carmenes del Mar.

The home owners want to remind Moreno that in February 2016 his political party the PP, who were then in opposition, tabled a resolution to the Andalucian Parliament that asked for emergency repairs to Carmenes del Mar. The non-binding resolution, supported by the PP, Ciudadanos and Podemos, was approved. Four years later Moreno's party now governs Andalucia, and the Carmenes residents wonder if an issue that he once claimed was "a matter of justice" was merely a cynical political ploy to unseat the PSOE in Andalucia.

Supreme Court sides with Carmenes del Mar residents

After a seemingly endless wait, the Supreme Court of Spain has rejected the final appeal by those responsible for the horrendous damage to the homes of the residents of Carmenes del Mar. The original verdict condeming the engineers, architects and other professionals who developed the urbanisations was handed down in November 2014, when the judge ordered the defendants to cover the full cost of repairing the constuction defects. Two appeals and more than 5 years later, the Supreme Court has at last upheld the original verdict. The Supreme Court ruling is final and cannot be appealed.

While this is good news for Carmenes del Mar, it is unfortunately not the end of the story. The defendants have filed for bankruptcy and there is no prospect of recovering the funds necessary to carry out the repairs and stabilisation work required. Television channel La 1 revisits Carmenes del Mar

The daily La Mañana de la 1 television show revisited Cármenes del Mar this week in a segment that highlights once again the plight of home owners living under the threat of eviction. The dangerous condition of parts of the urbanisation continues to be ignored by the Junta de Andalucia and Almuñecar Town Hall, while the residents continue fighting for justice through the courts.

 

Carmenes del Mar survey

A student of Physical Geography at Durham University in the UK has chosen as the subject of her dissertation the damage to property and infrastructure caused by landslides in Carmenes del Mar. As part of her research she is inviting people who have owned or rented property in Carmenes del Mar to take part in a survey. The survey is completely anonymous, and results will be shared with the Geography Department at Durham University and a team of researchers at the University of Granada.

Rodriguez-Acosta brothers to be investigated for fraud in relation to Carmenes del Mar

A court in Granada has summoned the Rodriguez-Acosta brothers, owners of the Comarex property development company that built Carmenes de Mar, to testify in court in relation to the urbanisation. In January the Provincial Court of Granada rejected the appeal of Cerro Gordo S.L., the Comarex company that was found responsible for the building defects in Carmenes del Mar and ordered to repair the damage. The company, however, has declared itself insolvent and has entered receivership. The Comarex Group have been accused of fraudulently declaring bankruptcy as a ploy to avoid paying for the repairs.

The matter is being investigated by the Granada Magistrate's court which has summoned the Rodriguez-Acosta brothers to testify on the 9th of March.
