The television program Andalusia Direct recently visited Carmenes del Mar to talk to residents and cover the reaciot to the recent Supreme Court ruling in favour of the residents of the La Herradura urbanisations.
After a seemingly endless wait, the Supreme Court of Spain has rejected the final appeal by those responsible for the horrendous damage to the homes of the residents of Carmenes del Mar. The original verdict condeming the engineers, architects and other professionals who developed the urbanisations was handed down in November 2014, when the judge ordered the defendants to cover the full cost of repairing the constuction defects. Two appeals and more than 5 years later, the Supreme Court has at last upheld the original verdict. The Supreme Court ruling is final and cannot be appealed.
While this is good news for Carmenes del Mar, it is unfortunately not the end of the story. The defendants have filed for bankruptcy and there is no prospect of recovering the funds necessary to carry out the repairs and stabilisation work required.
